Arusberita.id – Isu pembatasan jam operasional warung Madura yang viral dan dikritik banyak pihak, dibantah Kementerian Koperasi dan Usaha Kecil Menengah (Kemenkop UKM).
Sektretaris Kemenkop UKM, Arif Rahman Hakim mengaku, telah meninjau Peraturan Daerah Kabupaten Klungkung Nomor 13 Tahun 2018 tentang Penataan dan Pembinaan Pasar Rakyat, Pusat Perbelanjaan dan Toko Swalayan.
Arif menyimpulkan, tidak ada aturan yang melarang spesifik warung Madura beroperasi selama 24 jam. Dalam Perda tersebut, pengaturan terkait jam operasional justru berlaku bagi pelaku usaha ritel modern, minimarket, hypermarket, department store, serta supermarket. “Dengan batasan jam operasional tertentu,” kata Arif dalam keterangan resminya, Minggu (28/4/2024).
Arif memastikan pihaknya akan segera meminta penjelasan lebih lanjut kepada Pemerintah Daerah terkait aturan pembatasan jam operasional yang sedang berkembang di masyarakat.
“Kami juga akan mengevaluasi kebijakan daerah yang kontraproduktif dengan kepentingan UMKM, termasuk evaluasi program dan anggaran pemda untuk mendukung UMKM,” tegasnya.
Arif membantah adanya keberpihakan Kemenkop UKM terhadap minimarket atau usaha besar lainnya soal rencana pembatasan jam operasional Warung Madura.
Ia menegaskan, Kemenkop UKM akan melindungi UMKM dari ancaman ritel modern yang ekspansif, sekaligus mengajak masyarakat untuk berbelanja di warung-warung milik UMKM.
Pada prinsipnya, kami terus berupaya memberikan berbagai kemudahan, pelindungan, dan pemberdayaan bagi pelaku UMKM,” tuturnya.
Hal tersebut, ujar dia, telah tertuang dalam Peraturan Pemerintah Nomor 7 Tahun 2021.
Salah satu amanat dalam beleid tersebut, setiap kementerian/lembaga dan Pemerintah daerah memiliki layanan bantuan hukum dan pendampingan kepada pelaku UMKM, yang meliputi penyaluran hukum, konsultasi hukum, mediasi, serta penyusunan dokumen hukum.
“Layanan bantuan dan pendampingan hukum tersebut dapat diakses bagi para pelaku UMKM yang merasa dirugikan,” jelasnya.
Ketua Umum Dewan Pimpinan Pusat Ikatan keluarga Madura (Ikama) Muhammad Rawi mengaku berterima kasih jika memang tidak ada larangan warung Madura buka 24 jam.
“Memang pelaku usaha warung Madura ini harus dibina dan dibimbing sebagai UMKM lalu diarahkan agar mereka sesuai standar baku di Kemenkop dan UKM di wilayah masing-masing,” kata Rawi.
Menurut Rawi, keberadaan warung Madura selama ini membuka lapangan kerja di daerah-daerah.
“Mereka mandiri dan tidak merepotkan negara. Mereka membuka lapangan kerja dan dari mereka pula, bisa menjadi mitra aparat penegak hukum dan lainnya,” ungkapnya.
Ia berharap negara hadir dan membina pelaku usaha warung Madura. Bukan sebaliknya, malah membatasi.
“Kami hadir memberikan solusi kepada masyarakat. Pada saat banyak pusat perbelanjaan tutup, kami menyediakan yang dibutuhkan masyarakat. Kami butuh dirangkul dan dibina, bukan dibinasakan,” tegasnya.
Sementara Anggota Komisi VI DPR Achmad Baidowi menilai, pedagang toko kelontong seharusnya mendapatkan perlindungan bukan aturan yang memberatkan.
“Pengusaha mikro kecil seperti warung Madura perlu mendapatkan perlindungan, bukan malah diatur oleh aturan yang memberatkan,” kata Awiek, sapaan akrab Achmad Baidowi.
Seharusnya, kata Awiek, Pemerintah memberikan solusi terhadap pelaku usaha kecil, bukan mempersempit peluang usaha.
Sebab, keberadaan warung Madura justru memiliki dampak positif pada perekonomian masyarakat kecil.
Politisi Partai Persatuan Pembangunan (PPP) ini mengatakan, membuka warung kecil 24 jam tak hanya dilakukan oleh masyarakat Madura di sejumlah kota besar, namun juga warga Indonesia lainnya dari berbagai daerah.
Sehingga, perlu ada keberpihakan pada masyarakat kecil yang ditunjukkan oleh pemerintah.
Awiek juga melihat, selama ini tidak ada aspek atau dampak negatif yang ditimbulkan warung Madura.
Malah keberadaan warung kecil 24 jam membantu kebutuhan warga sepanjang hari dan turut menjaga keamanan lingkungan.
Menurutnya, imbauan itu lebih tepat jika diberlakukan untuk toko-toko seperti minimarket yang pengelolanya adalah pengusaha besar.
