Arusberita.id – Presiden Joko Widodo atau Jokowi menyatakan akan melakukan evaluasi terhadap perwira TNI maupun Polri yang menduduki jabatan sipil setelah munculnya kisruh soal suap Kepala Basarnas Marsekal Madya Henri Alfiandi. Dia menyatakan tak ingin korupsi terjadi di pos-pos penting.
“Semuanya akan dievaluasi. tidak hanya masalah itu (Basarnas), semuanya,” kata Jokowi usai meresmikan Sodetan Ciliwung di Jakarta, Senin 31 Juli 2023.
Presiden mengatakan, evaluasi tersebut didasari bukan hanya karena terjadinya konflik antar instansi pada penanganan kasus Basarnas, melainkan agar tidak lagi terjadi praktik-praktik korupsi di lembaga negara.
“Karena kita tidak mau lagi di tempat-tempat yang sangat penting terjadi penyelewengan, terjadi korupsi,” kata Jokowi.
Soal kisruh penanganan kasus suap Kepala Basarnas, Jokowi memilih tidak ambil pusing dan meminta agar Komisi Pemberantasan Korupsi (KPK) dan TNI berkoordinasi.
“Ya itu masalah menurut saya masalah koordinasi yang harus dilakukan semua instansi sesuai dengan kewenangan masing-masing menurut aturan,” kata Jokowi.
Menurut Jokowi, jika koordinasi antar instansi berjalan dengan baik, maka tidak akan terjadi kekisruhan penanganan perkara seperti saat ini.
“Kalau itu (koordinasi) dilakukan, rampung,” kata Jokowi.
Berawal dari OTT
Sebelumnya, KPK menetapkan Kepala Basarnas Marsdya Henri Alfiandi dan Koordinator Staf Administrasi (Koorsmin) Kabasarnas Letnan Kolonel Arif Budi Cahyanto sebagai tersangka suap di instansi pencarian dan pertolongan tersebut pada Rabu 26 Juli 2023. Penetapan tersebut dilakukan setelah KPK menggelar operasi tangkap tangan sehari sebelumnya.
Dalam operasi itu, KPK menangkap Arif beserta Direktur Utama PT Intertekno Grafika Sejati, Marilya dan Direktur Utama PT Kindah Abadi Utama, Roni Aidil pada Selasa, 25 Juli 2023.
Marilya dan Roni disebut tengah menyerahkan uang senilai Rp 999,7 juta kepada Arif. Uang itu disebut sebagai bagian dari commitment fee karena PT Intertekno dan PT Kindah menang dalam sejumlah proyek pengadaan barang di Basarnas. KPK juga menetapkan atasan Marilya, Komisaris Utama PT Multi Grafika Cipta Sejati, Mulsunadi Gunawan, sebagai tersangka.
Berselang dua hari tepatnya Jumat 28 Juli 2023, rombongan TNI yang dipimpin oleh Komandan Pusat Polisi Militer (Puspom) TNI Marsekal Muda Agung Handoko mendatangi KPK untuk mengklarifikasi soal ditetapkannya tersangka Henri dan Arif yang dianggap melebihi kewenangannya dalam menjalankan tugas karena tidak berkoordinasi dengan TNI.
Agung mengatakan, baik Henri maupun Arif saat menjalankan tugasnya sebagai anggota Basarnas masih berstatus TNI aktif, sehingga penetapan tersangka bagi anggota TNI aktif tidak bisa sembarangan dilakukan selain oleh Puspom TNI.
Wakil Ketua KPK Johanis Tanak langsung menyatakan bahwa penetapan tersangka terhadap Henri dan Arif merupakan kekhilafan dari anak buahnya dan meminta maaf atas kekeliruan tersebut. Johanis mengatakan, berangkat dari kasus tersebut, pihaknya akan berbenah dan lebih berhati-hati dalam penanganan kasus korupsi khususnya yang melibatkan TNI.
“Disini ada kekliruan, kekhilafan dari tim kami yang melakukan penangkapan, oleh karena itu atas kekhilafan ini kami mohon dapat dimaafkan dan kedepan kami akan berupaya kerjasama yang baik antara TNI dengan KPK,” kata Johanis.
Ketua KPK bantah tak berkoordinasi dengan TNI
Ketua KPK Firli Bahuri kemudian mengeluarkan pernyataan seolah membantah pihaknya tidak berkoordinasi dengan TNI saat penetapan tersangka Henri dan Arif.
“KPK telah melibatkan POM TNI sejak awal, untuk mengikuti gelar perkara sampai dengan penetapan status perkara dan status hukum para pihak terkait (kasus Basarnas),” kata Firli melalui keterangan resminya yang diterima Tempo, Ahad, 30 Juli 2023.
Firli menyatakan, setelah dilakukan tangkap tangan, maka terhadap peristiwa dugaan tindak pidana tersebut harus sudah dapat ditentukan dan ditetapkan sebagai peristiwa tindak pidana korupsi serta status hukum para pihak terkait dalam waktu satu kali 24 jam.
“Maka KPK kemudian menaikkan status perkara ini ke tahap penyidikan dan menetapkan para pihak atas perbuatannya sebagai tersangka,” kata Firli.
Firli menjelaskan, karena mengetahui ada oknum TNI dalam operasi tangkap tangan tersebut, maka KPK segera berkoordinasi dengan POM TNI untuk gelar perkaranya. Sebagai pucuk pimpinan KPK, Firli menyatakan siap bertanggungjawab dengan pernyataannya tersebut.
“Seluruh proses penyelidikan, penyidikan, penuntutan perkara dugaan tindak pidana korupsi yang telah dilakukan oleh segenap insan KPK, serta berbagai upaya pencegahan dan pendidikan antikorupsi, adalah tanggung jawab penuh Pimpinan KPK,” kata Firli.
Sejumlah lembaga lantas mendukung KPK untuk tetap menangani perkara kasus korupsi yang melibatkan Kepala Basarnas Marsdya Henri Alfiandi dan Letkol Arif Budi Cahyanto yang merupakan TNI aktif tersebut. Direktur Eksekutif Transparansi Internasional Indonesia, Usman Hamid, pun melontarkan sejumlah landasan hukum yang bisa digunakan KPK untuk menjerat Marsdya Henri Alfiandi dan Letkol Arif Budi Cahyanto.
