Arusberita.id – Pemerintah telah resmi mengeluarkan Peraturan Pemerintah (PP) Nomor 51 Tahun 2023 tentang Perubahan atas Peraturan Pemerintah Nomor 36 Tahun 2021 terkait Pengupahan. Aturan yang ditandatangani Presiden Jokowi itu ini mencakup formula perhitungan baru Upah Minimum.
Di dalam PP yang baru diterbitkan tujuh hari ini, terdapat ketentuan baru yang menjamin bahwa upah minimum tidak akan turun meski pertumbuhan ekonomi negatif.
Hal itu terjadi, karena upah minimum tahun berikutnya akan disamakan dengan upah minimum tahun berjalan.
“Jika pertumbuhan ekonomi bernilai negatif maka nilai upah minimum tahun berikutnya ditetapkan sama dengan nilai upah minimum tahun berjalan,” tulis Instagram Kementerian Ketenagakerjaan @kemnaker, dikutip Jumat (17/11/2023).
Sebelumnya, Direktur Jenderal Pembinaan Hubungan Industrial dan Jaminan Sosial Tenaga Kerja Kementerian Ketenagakerjaan (Kemnaker) Indah Anggoro Putri menjelaskan, kalaupun ada pertumbuhan ekonomi yang negatif atau terjadi lonjakan inflasi yang tinggi sehingga menyebabkan ekonomi jadi tertekan, maka upah minimum tidak akan negatif dan upah tidak akan mengalami penurunan, karena tetap menggunakan perhitungan upah tahun berjalan.
“Misalnya, pakai PP 51/2023, kabupaten yang kita tinggali (terjadi bencana) tsunami, lalu anjok, pertumbuhan ekonomi drop dan inflasi, jadi upah tahun depan kalau pakai rumus PP ini minus, tadinya pekerja digaji Rp 4 juta (per bulan), tapi karena ada tsunami, pekerja-pekerja yang dibawah 1 tahun gajinya jadi cuma Rp 3,9 juta. Dengan PP in di pasal 26 dijamin tidak turun, sama dengan tahun berjalan,” terang Indah saat ditemui di Gedung DPR RI, Selasa (14/11/2023).
Indah menegaskan, menggunakan PP 51/2023, maka dengan kondisi demikian tidak akan membuat upah menjadi turun maupun naik.
“Gak akan naik, tapi juga nggak akan turun. Ini salah satu bagusnya PP ini,” lanjutnya.
Pada prinsipnya formula dalam aturan tersebut mengatur agar upah minimum setiap tahun mengalami kenaikan, sepanjang kondisi perekonomian dan ketenagakerjaan di daerah tersebut tidak mengalami tekanan. Sementara, jika ekonomi tengah lesu, maka upah minimum juga dijamin tidak akan turun.
